Child support for special needs child

First post here but I don't know where to turn.

I am divorcing. I have 3 children with my ex husband (one with autism, one with aspergers) and a baby with my new partner. My ex husband has the children 61 nights per year as he works abroad. He has been in contact with CMS to get a calculation, but he disputes it and they won't help unless we are prepared to go to court.

My autistic son spends 3 nights per week in respite. My ex husband says he should not be paying child support for those nights. I am inclined to agree, fair is fair.

Has anyone been in this situation? How did it affect your child support payments?

I don't think it will matter. If it doesn't matter for child benefit or child tax credits then it won't matter for csa. You still have the child in your care if it's daytime you still buy the clothes for that child to wear in respite and so on. Where the child sleeps shouldn't matter xx
