EHCP - advice please

Hello, does anyone know if I can apply for an EHCP for my son if I have several reports saying he needs it (OT, SALT, community PAED & the Nuffield) even if school are still not putting in enough hours yet
(School are crap with these things)

He is nearly 6, has dyspraxia, verbal dyspraxia and spd. I need to get him more salt and ot but it seems impossible without EHCP. At the minute we are trying to do what we can we private ot/salt

I’d be very grateful for any advice

Of course you can. Make a parental request using the model letter from IPSEA and include professional reports. If they use the 'hours' reason for not assessing, remind them what the Code of Practice says and appeal their decision.

Thanks for your reply. The school are of the opinion that I don’t need to worry about an EHCP as a parent because we only need it if he needed more hours than the 16 (and he is getting nowhere near that ) and it’s more of a school issue

However, he’s not getting the help he needs and the only way to get the salt and ot to see him enough is with an EHCP as far as I can tell...

(I forgot to mention his speech disorder in the original post)

Do you think I should just go for it?
What do the codes of practice say?
If I get an EHCP can I request my own salt/ot to see him rather than wait for the overstretched la ones?

Go to the IPSEA website and lots of your questions will be answered there. You can get OT and SALT specified in section F, then the Licak Authority has to provide it . But unless you request a personal budget, this is normally via NHS providers. Is a speech and language unit an option for your son? That's how my son got a high level of therapy for verbal dyspraxia.

School won’t support me with an EHCP but I believe they are failing him. Xxx

An EHCP is when a child needs support not usually provided within school and available within school.

He has private salt and ot because school cannot provide the support. Therefore he needs an EHCP. Agree with using IPSea template.

Also remember to focus on what your asking at each point.
Currently it's that your child has or may have Sen and may need an EHCP.

Then keep reiterating he has Sen and may need an EHCP and assessment is needed to determine that.

FWIW ds school didn't support me with EHCP. In fact seemed to fight me after I applied for one and were obstructive Confused

Ds has an EHCP for 20 hours.

Just a quick update.... I applied for the EHCP myself and got it!

School are still unhelpful,he won’t be there much longer!

Hi,

Just a warning - although hopefully unnecessary for you - in my L.A. private OT and SALT reports count for nothing unless you are willing to go to tribunal. So, do check before commissioning expensive private ones. The NHS OT and SALT should have to provide reports in the timeframe of evidence collecting - but this depends on your L.A. requesting them, which mine didn't...

Thanks guys. I just wanted to post in case anyone else was going through the same dilemmas.

Saturday- you are right, when they decided to go ahead the LA got an ed phyc, salt, ot and paed to assess him. So I guess they didn’t take the word of the private reports, although it was definitely the private reports that gave me enough proof to trigger the assessments. Such a stupid catch 22!

i have been requesting one for years and school have not supported it, kept saying they were meeting his needs (they were not) Finally today the resource panel are meeting to decide if he gets his plan. (Everything crossed). We had to reach crisis point before school would support the idea, crisis point meant school refusal , tantrums , outbursts etc. He i ASD but very High functioning and was coping academically, Ed Pysch said he could see why he was 'overlooked' because he was no trouble in lessons and meeting the expected levels. Apply for one yourself - we did am dearly hoping something is in place for start of 2ndry so he can have a +ve experince there
