Refusal to assess

Just what it says above do LEA's just refuse to assess and hope we will not fight! We have lost at tribunal before, don't really want to go through it all again but may have to.

I think they do, yes. However I believe appeals against refusal to assess are done on paper now rather than actually attending tribunal. And there is mediation, I know one person who has overturned it this way.

Tribunal considering Refusal to Assess on paper only now - unless you ask for an oral hearing. Would have been a great idea in our case as Judge said test was so straightforward the LA should have just said yes at once. Sent them away with flee in ear! Fabulous. Appeal is my advice

Yes, in my experience refuse as standard!

Definitely appeal. The tribunal focuses on the fact that the test for assessment is very straightforward - does or may the child have SEN, may he need an EHCP. LAs seem to build in all sorts of extra tests and hurdles that the law doesn't support.

My boy presently attends a private specialist school funded by myself recommendation was mainstream with support. I thought it would be SO simple the levels he achieves now SO much better then when he was at primary been there nearly a year. Even school Senco said it would be VERY difficult to get an EHCP for him. Need to decide what to do

Well I suppose it depends whether you are able to keep funding him yourself and what implications that has for your family finances. For the price of a year or so's fees you could appeal and get private assessments made, use a solicitor etc but if you fail then that money is gone, however you may well succeed. It would probably be worth contacting SOSSEN to see what they think your chances are. My DS goes to a private SS, many pupils are privately funded as they would have gone to private school anyway and the parents have budgetted for it. But a large proportion do have EHCPs.

Thank you I can pay for him if absolutely have to but why should I? And in my head somewhere it's not fair on my Dd who already suffers having himself as a brother. Getting him there and back is exhausting 3 hours a day in the car which is also suffering! Also means I can't work at present due to timings of drop off and collection I'll ring SOSSEN tommorrow see what they say
