EHCP request refused because too early?

Wondered if anyone could advise on LA refusing to assess? On the advice of my 3yr old son's excellent SN nursery we applied for EHCP assessment. We've just had our request rejected by LA on the grounds that he is well supported at nursery, that we had applied too early and could consider reapplying again in 6 months. However the deadline for applications to the SS is this December & they will only take children with a plan. Meanwhile the MSS wouldn't be able to cater for his needs unless he had 1-to1 support - which also means he needs a Plan. Not sure where to go from here?

My daughter got a plan when. She was still in nursery. We did have to prove first that the early years section and action plus stuff wasn't working. Bit of a waste of time because she was quite severely affected. I'd advise you to get on the phone to ipsea Asap. Collect written evidence of everything and question whatever the local authority tells you. Good luck.

It's nonsense to say it's too early - the Code of Practice isn't called "0 to 25" for nothing. It's not good enough for them to say he's well supported in nursery if it's necessary for support to be in place when he starts school. I'd suggest you appeal to the tribunal.
