Hi all. Hoping someone can help. I have children with statements. I am wanting to move house out of county so that they can attend a different school. I know that i should have the new school written on their statements before i move house, incase the new LA say that there is a cheaper school that my kids should attend. My questions are, what council would be funding my kids place? Is it where i currently reside or where i want to move to? Also, would my current council sign off an out of county school change with little resistance if they know we are moving? Thanks

Hi Wizzy

The new LEA will eventually be responsible for the statements/Plans, I think. As soon as you are in a new place, the old LEA has something like 15 days to transfer the statement/Plan and then within a certain time the new LEA is supposed to adopt the Plan (although I think they might have the right to do their own review). I assume this also applies to Statements but someone else might know more. My dd has an EHCP.

I expect that it also depends on which LEAs are involved. Our original LEA wouldn't even consult with the school that we moved for but the new LEA immediately agreed a part funding arrangement with us for that school. Our new LEA said that they would have been able to prepare for moves into country a few weeks before the move takes place so it might be worth getting in touch with your new LEA and talking things through with them. I didn't actually speak to them until we moved but I probably should have done it before. So far, they have been much better than the old LEA.

I remember that I emailed IPSEA at the time with some questions and got some help from one of their advisors.

if you get the school you want in your statement by your LA then I would not move house. if you love, the new LA becomes responsible and they can (and if placement is expensive) will review and you might lose the placement.

The reason i was wanting to move house was to avoid having to be boarders. Didnt realise the new LA could reject the school
