DLA APPEALS-Time Scales

Does anyone have any experience will DLA appeals?, My Son has autism along with fine motor skills delay, speech delay, sensory issues etc. I am currently appealing DWP decision.
I was wondering do they have to give you a response within 40 days? or can it take months to await a decision?

is your appeal going to tribunal?

we appealed and had a decision within 3 weeks. The DLA look at your claim again before it goes to tribunal and sometimes change their decision.

Sorry I should have added that in my first post, The Specialist HV and I decided to do it through papers alone would this mean it would take longer?

the appeal form is very straight forward. have you had a mandatory reconsideration?

Hi, Yes went through Mandatory reconsideration and added additional papers plus a supporting statement from the HV to reconsider my claim.
Then received a very confusing letter regarding my reconsideration saying my Child would receive middle rate which I was happy with only to contact DWP saying it was a computer error and my little one would receive lower care rate.
Spoke to HV who said my little one should be receiving middle rate care and we decided to appeal with papers which included the appeals form, 12 pages of what extra care needs my child has, and 7 letters from other professionals.

just go through the cerebra guide (google it). it is a phantasic guide for claiming DLA.

fwiw - we went from no DLA award (initial decision and reconsideration) to High Rate Care when I sent my appeal in. I do think they often try it on and rely on people not challenging their decisions. good luck!

Thank you for all your help, I used the Cerebra guide as part of the appeals, I wish I knew about it sooner it was much easier using the guide.
Wow no DLA to High rate care, I do wonder how they can get them so wrong the first time round.
