Statement is now just under three weeks late. No word in any form at all from anyone as to why. JR letter sent, formal complaint sent and the reply time has passed.

Can I take this to ofsted? I have a totally non verbal three year old who has to get past their panels for a preschool in the coming weeks and parent partnership has told me he can't be going to panel if no one has written to me to confirm that

Are you past the deadline for the JR letter? If not, I'd wait for that.

The jr letter is for the 7th. I don't realise that now I have started jr my complaint has been dropped and I can't complain to LGO. I have bad feeling that there's never to be any statement. He's screwed whatever I do. Oh well he was screwed from the day he was born.

The same tossers are in charge of my toddler going to a pre school. The best I can hope for is he bites and hits the teachers in ms like he does to us. If not he is also written off.

They really can't possibly fail to issue a statement. It's a tribunal order, they can't decide they're not going to obey, and if they did, the court would order them to do so via the JR. Also I assume they would end up paying your solicitors' costs, which could be very expensive.

Was your complaint only about the statement? If so, it's correct that the JR will supersede it, but that's fine if it gets you what you want, isn't it?

You can certainly bring all this to Ofsted's attention, but their power - and arguably, their willingness - to do anything about it is very limited right now. Best to think of it as something that keeps the heat on the LA.

Ofsted will, at some point in the next 12 months, start inspecting LA SEN services to ensure that they are playing their part in the glorious new future for SEN provision brought about by last September's legislation.

Right now, Ofsted are still working out how they are going to do that. They don't know right now, for a variety of reasons - one of them being that except for a few decent inspectors, they corporately know fuck-all about SEN. And fuck alone knows what will actually happen to LAs if Ofsted find them below-par.

With luck, Ofsted would file away stuff on the unlawful non-appearance of the statement, and take it into consideration when they come to inspect your LA. I wouldn't count on this happening, though.

OTOH, Ofsted would be more willing to listen right now to the shit that your school have put you through. This is very much their core business, and you have ample evidence to throw their way.

Well my complaint also covered the tribunal rep but he will get off Scott free now.

My formal complaint to the school governers never got to the governor. The head opened it. He asked me what I wanted to do. I said to write to me setting out what we agreed - and I never got it ...

Are they saying they've dropped your complaint, or are they saying it is on hold till they have sorted out the JR issue? The latter sounds more likely.

If your complaint covered matters that aren't dealt with in the JR letter, just tell the LA that the solicitor isn't instructed to deal with that matter, it has nothing whatsoever to do with the JR which is about the simple issue of their failure to issue a statement, and you require the complaint to be dealt with. If they still won't deal with it, tell them you want to go to the next stage in the complaint process. And if they still won't, go to the Local Government Ombudsman.

I told them the above via email yesterday icimoi I said the rest of my complaint still stands, they either give me my answer as due today or take my email as notice to re raise it as new so either way I can get it through to LGO in 30working days from today.

I feel calm today. I don't really give two shits about what happens next.

I will get the pisspoor statement, appeal contents then take them to jr to get it implemented. It's all just mindless games.

No gets hurt as it's not serious. Just pure mindless fun.

See how I can now laugh. I'm sure their excuses will stop me going to LGO as a respectable statement for ds2 or a asd unit for ds3 was ever a possibility

2boys less than a week to the JR deadline. If they reply with a rubbish statement you can cane them in the next Tribunal and if they don't, you can cane them in the court.
