Has anyone ever heard of multiple parents not receiving their amended statement with their secondary allocation in time for the 15th February cut off?

I have not heard and neither have multiple parents in county. Rumours of a delay and absolutely no information on the website. No one has a clue what is happening. A few parents have heard but vast majority are saying they have not.

I am worried - I secured an amendment to reflect special provision prior to submitting the form and chosen school is nearest, most appropriate but feeling unsettled as its a statutory requir,net that is being breached.

If it was just me I would assume it was the post but it's not.

I had this last year and completely panicked. It was the beginning of March before I got the amended statement.

on facebook there are parents all over the country who have not heard - this year it seems particulary bad for some reason - mine arrived this morning! thankfully they are naming the current indie school which is a relief and clearly left it as late as possible as some bizarre mind game probably due to the recent tribunal win over my other child.

I am wondering if the nonsense from last academic year as to whether this year group would migrate to EHC has impacted - we struggled to engage professionals.

I also worry about number of special provision places.

BJK I wonder if we are in the same county - I might have seen your post on a group beginning with T?

It wouldn't be surprising, as a lot of LAs seem to be really struggling with the transition to EHC Plans.

I'd suggest starting to pester from Monday. If they haven't produced the amended statement or EHCP by the following week, tell them you'll be instructing a lawyer to start judicial review proceedings. And if that doesn't work, go to a solicitor who does legal aid (because judicial review would be in children's names) to get a formal pre-action letter sent out.

That's fine are: legal proceedings but on a more practical level I have transition work booked with my child, there are things we need to be discussing with the next school urgently - this delay is unacceptable - yes even a few days... My child knew the school placement was due Sad

He asked last night if those idiots in the LA knew what they were doing Grin - atleast we know the drip feeding / soctal stories have worked.

Wonder if they're waiting till 2March national offer date. To see which schools have excess places left once the non statement mainstream dc have had their offers. So they can play "no top-up £, sorry" hardball with under filled schools

Possibly but our amendment was special provision so unless they are going back on that it doesn't apply to us

There is no sanction for missing the deadline, so new law plus austerity and I would guess it is worse this year than last, but probably next year worse than this

I received it... Albeit a day late....

All the amendments remained and school of choice was named.

However, I believe that is not the case for others so I will pass the advice.

I am also going to write to the LA and suggest that they keep parents informed better next year. It's very stressful!

There are possible sanctions for missing the deadline. As manish says, you could potentially get legal aid in a child's name to take judicial review proceedings to enforce it. And you could go through the complaints process, including the Ombudsman, though there's probably little point unless they either go a fairly long way over the deadline or a lot of children are affected. The benefit of going to the Ombudsman is that he can recommend they pay compensation, and anyway LAs seem to hate being named and shamed by them.

I haven't received an updated statement. I have spoken to the LA. They have told me that because he is due to be transferred onto EHCP they dont have to.

I have neen given notice of the Transfer review meeting.

Is he in a phase transfer? If so, it looks like no excuse applies- the old statement stands, with amendments under old rules, till the EHCP is issued.

Otherwise, I guess it might be a reasonable reason for a short delay, depending when the EHCP is due.
