I can't talk to the school or nhs about ds unless it's via la rep. Can he do this?

My witness wants to see ds at school but that's got to go via the rep. Witness says unless they get access I'm going to loose and if I don't have a good chance of winning they won't represent me!!

What a nightmare! The la rep can sit on my email and not grant access or I pay hundreds and my witness doesn't find what she wants and doesn't attend tribunal anyway!

You can apply to SENDIST for them to force the school to allow your witness in to see your DS.

which witness is it 2boys? remember its very unusual to have more than 3 witnesses even at a part2 3 and 4 appeal so cant see the tribunal allowing the LA 5 witness for an appeal against an NIL!

They are only allowed 3 witnesses altogether. They can apply for more but it doesn't mean they will allowed them. If i was you i would oppose extra witnesses from the LA.
Apply for SENDIST to order the school to allow your witness in. It's just a form that you have to fill in. The LA cannot refuse to allow your witnesses in, just as it would be bad form if you didn't consent to their witnesses seeing DS. Schools always do whatever the LA says but the LA is not above SENDIST.

Yes, use the Request for Changes form on the tribunal website, explain that you've asked the school who won't answer, and ask them to make an order that your expert be allowed access. Email it to the tribunal, copy it to the rep, and mark it urgent.

Also ask your expert when she's available, check that dc will be doing something at the times she suggests that will be helpful to her, and ask the tribunal to say it has to be one of the times she offers. That's because schools have an uncanny habit of telling experts they can only come at the end of the day when there's no-one there, or when they've sent the class out somewhere, or other times -when they hope they can hide anything that shows they're not doing their job-.

Honestly, don't lose heart. If the LA rep thinks he can turn up with 5 witnesses, he clearly has little or no experience of tribunal work. You can do this!

When did the LEA start having jurisdiction over the NHS?!! How can they possibly say you can't speak to the NHS without contacting the LEA? Perhaps you should ask if he wants to come to your smear test too?! I would tell them to get lost on that one!

I can email you the form my advocate send to Tribunal in order to force school to allow EP in - in our case the Head thought it's up to him if he allows EP in... Message me your email if you want.

The LA case worker has shown himself to be a bull shitter (don't forget how long he predicted the hearing would take) and now he is saying they will have 5 expert witnesses for a NIL hearing. Really? More bollocks. Bracket him. He is really not important in the long term. Save enough strength to fight another day (and there will be another day). He is just trying to make you give up. But it is impersonal. Post here if you doubt yourself. Confident lies always throw me in meetings even though I know they are lies. I always have to come home and google because I think I must have misunderstood. Not found that to be the case yet. Keep going.

Keep going. On your calendar mark in bold, the day AFTER tribunal. Regularly look at it. THAT is the significant date, not the one before, and it will come sure enough.

This guy straight out of uni, no skills, no morals & no prospects wants a lawyer's job. May well have got someone else to write his dissertation, too. In his head, LA defeat at Tribunal would risk blocking his destiny.

He can lie, he can cheat, he can try & bully you. But he can't stop witnesses having access to your dc, he can't stop you knowing your DS case inside out, and he can't stop being thick as sh*t himself.

Sit tight & document his errors. Object to every item of nonsense. Get SENDIST to intervene when he tries to make a monkey of them. It won't look good.
