LEA have backed out

Of the Tribunal next week.
I received a letter this morning saying that they have agreed to assess DS and will not be attending the SENDIST tribunal next week.

The head woman from SEN phoned me this morning and asked was i in agreement with the letter and i couldnt resist asking her "does this mean that you can assess a child in the home?"

She said yes despite last month arguing that it was not possible.

SO, round 1 to us but we still have a long way to go as we want him in an ASD special school which the LEA will have to fund and we will have a fight over that.

Excellent news Jenk. What a load of bo$$ocks they talk too! Can't assess in the home.... grrrr. I've heard SO many times of LEAs backing out of tribunals as it gets nearer the time, a day before, a week before and even outside the hearing room (or whatever its called) 10 mins before!

Thanks guys

I have been smiling for the last 2 days.

Our next fight will be to get him statemented and then a place in the nearest ASD school which will have to be funded by the LEA, but im prepared for a long battle and DS is NOT going back into school until he has the proper support.
On Tuesday DS was at my mums as we were on a course and his tutor came to my mums house and was saying things like "Oh what a shame he,s not gone back into school, you see the problem is that they need to see this behaviour that he displays"
So my mum said "What would you have us put him back in and be soiling and wetting himself, is that the sort of behaviour that you need to see, thats tantamount to abuse if you ask me" , I was Dead shocked because my mum is really quiet!!!
It shut his tutor up anyway, the other thing that ive got to get through to his tutor is to stop mithering him to write stories because
A.
He has trouble with handwriting and our psych says he has Dyspraxia and should have a laptop.
and
B.
He has no bloody imagination unless you are talking spongebob or yu-gi-oh cards, the other day she said to him "imagine you are on a shopping trip to Manchester"
and Ds replied "No thats lies cos i cant go shopping to Manchester on my own"
and she said "well just pretend"
and he said "NO NO NO" so my mum asked her to move on to something else.
So i shall be having words next week.

"ding' 'ding' round two - I think although you say you have a long way to go - I think thinking of it as rounds is a fab way - you know - just keep pounding away at them....

Brilliant news re the LEA backing down (thought they might because the LEA in this case knew they were going to be carpeted by SENDIST!). Its truly amazing what both mentioning the word SENDIST and following it through can do to some LEA's.

Socci - appalled to see that this family you know of got this letter. IPSEA would be very interested to learn of this LEA's behaviour because its certainly illegal. This family should drop the LEA right in it.
