1st percentile statutory assess turned down twice

My son is going into year 3 had ed psych report that shows using the wechsler individual achievement test second uk edition that he is 1st percentile for word reading and 2nd for spelling ed psych made 14 recommendations that he requires yet a statutory assessment has been turned down twice any one in the same boat or has been??? Sick to death

Its a bluff by the LA - they are trying it on.

Lodge an appeal to SEND and they will carry out a Statutory Assessment. They will know that a Tribunal will not agree that level of difficulty can be addressed without an assessment.
Can the school provide against all of the recommendations?
How much will that cost?
If you give up then the LA will win and do it again to another child.

Yes im in the same position, appealed to tribunal and won so LA ordered to assess and they have now issued a Note in lieu so just appealed again, my daughter about to head into year six. School now saying she's age appropriate on the NC scales but EP reports place her 3-4 years behind so someone is telling porky pies. But yes its draining and all you can do is to keep fighting and don't give up.

We were also turned down for a statutory assessment but appealed instantly (with same info we had submitted for statutory assessment) and LA conceded 3 weeks later. Got meeting with member of council and school today to discuss support plan still going to appeal though

The woman from la was so snobby and just prattled on bout how the school does so much and that the school get plenty money and that she thinks it would be a good idea to just wait till hes year 5 for assessment well appeal is going in anyway hope you have some good news tomorrow

please do not wait until year 5 - that's the position I found myself in last year - im now in year 6 and they've issued a NIL ater one appeal to tribunal already - next appeal jan and im expecting another appeal after that which means its now highly likely there will be nothing inplace when she starts year 7 - I wish now I had started earlier but was fobbed off by the school for 6 months and by the previous school. why wait to year 5? if the child needs support put it in place now then maybe they wont need as much support as they head for secondary

Agree - do not wait until year 5. My DS had a terrible year 3 which resulted in me having to home ed him for his year 4. In year 3, he was refused SA. In year 4, whilst home ed'ing him, LA had to back down and issue a Statement which wasn't worth the paper it was written on. Following a successful appeal against the contents of the Statement, he is now in a wonderful specialist school and is now in year 6.

I am so glad I didn't wait. My DS's problems weren't going to get any better if I waited, so absolutely no point in waiting. The sooner help is given to children, the better.
