LEA have refused to even consider a statement for DS1

Disgraceful behaviour on the part of the LEA.

Appeal their crass decision; it is the only way forward.

Teacher said only they can appeal, as they applied and they won't. Is that true?

Sa, also being bullied again already, he ahs said there's no point in telling teachers as they don't care . black eye today, teacher said it was an accident, Sam said he told her that knowing she'd ignore him anyway.

Have spoken to IPSEA in the past, will give them a call.

Was tol this at the school class door, i complained about that from alst years Teacher and they said they'd sort it. I mean, the LEA didn't even let me know! basic respect, surely?

Paediatrician even wrote to the LEA apaprently begging them for a statement.

Go back and get all the evidence you can.

Have you been to Camhs? If so get them to back you up.

You do not need the school to re-apply. You are entirely within your rights to apply yourself.

I just find the whole thing outrageous. I have yet to find any child with AS/asd/language disorders/Adhd that do not need extra help at school.

It's enough to have your child dx with a life long disability and tbh why the hell should we have to figh, it should come automatically.

The system stinks. I am far from racist so please do not think I am but I remember how angry I was when dd was at ds's school. We were having to have every assessment under the sun blah de blah. Along come a family from another country who couldn't speak English and voila an interpretur was employed almost immediately full time. Hello? my own dd could hardly speak/comunicate at all and had nothing. It's just so unfair pc

I think you may have to wait six months to apply again though.

You should get a letter soon giving the reasons why ds was turned down.

Did he see a LEA EP, ime they seem to have a pretty good idea of whether or not your child will actually meet the right criteria.

maddiemo ~ that certainly wasn't the case with dd. We had to re-apply with enough evidence when panel sat again. We did and she got it.
Great thing about our borough is that the minute they agree to assess then you are 99.9% guaranteed to get the statement!

Peacy I am so sorry to read this, but sadly not that surprised

We have over 50 children in year 7 on the SEN regester, onlty two of them have a statement. Many, many kids get stuck on SA+ when it is obvious that they need the help that a statement could bring.

To be honest, the only children who currenlty arrive in Year 7 with a statement, are children who's needs are so marked that 5-6 years ago they would have automaticaly been granted a place in a special school. Without that level of need the kids get next to bugger all

Really BH? Must be a borough to borough thing.

If you can afford private reports Peachy it nay be worthwhile, we did this for ds3 and while the actually assessment {EP} was no different it was far more detailed in what ds needed as opposed to what my LEA would provide.

As I understand it (and I am happy to be corrected on this if anyone knows differently) if school apply for the statement and the LEA refuse the school have no right of appeal.

This does not affect you though and you can apply for the Statement yourself (infact you are better off doing it yourself rather than get school to do it for you).

You'll need to appeal to the panel (the nameless and faceless lot) who make the decisions. In my LEA they meet every three weeks so you certainly should not have to wait anything like six months. BTW six months is the average length of time it takes to set up a Statement.

My guess is you'll probably get some waffle from the LEA re their reasons of refusal.

The onus is very much on the parents these days to get the help that is needed for their child.

Stuff the school and apply for the statement yourself if you have not already done so.

We did see an Ed Psych from the LEA back last term, she ahsn't yet managed to send the report. She sat there by the window telling us Sam was fine ins chool whilst he beat up another kid outside she wouldn't look!

I have discovered that our LEA are being investigated by the Assembly because of their statementing appeals / refusals to assess.

Sam isn't on SA+, they will only put him on SA at the moment, even that is being withdrawn in terms of targets for six weeks for new teacher to guage where he is at
