HELP!!! me please appeal date set

Hiya

I need your help.

We had appealed DT2 DLA decision as he was awarded low rate only. Reconsideration said the same.

We go in fornt of the panel to appeal in person on 4th October andI so need to be ready cause they are horrid- remember my friend going though it.

Who can advise me please?

Would rather have personal experiences rather than a citizen advice opinion if that makes sense

PLEASE HELP!!!

No experience myself (yet!) but I'm waiting to hear about DD's renewal claim so feel for you. So bumping this as I know there are others who have gone to appeal who may be able to advise you........anyone?

I help parents who have children with autsim at appeals and so far EVERYONE has been totally different. It all depends on who is on the panel and how well they know their stuff. So far I have not had one lay person who actually knew anything about autism. So far so go though because we have won every appeal so don't be too down beat about this. What you need to prove is that your child needs much more care and support than a child of their age without a disability.

What were their reasons for only awarding you the low rate?

DT1 is currently being assesed for autism

Dt2(the one we are appealing)has development delay, dyspraxia(wont get confirmed dx of dyspraxia till school age???)

They have awarded DT2 low rate as they say he only needs an additional hours care a day than a noral 2.5yr old.

He chokes on food- every meal time unless it's soup, custard etc

We have physio and OT exercises to do everyday to help build his muscle tone.

There are days when he is in the bath 2-3 times in a day due to his legs being very painful and trying to alleviate some of his discomfort.

He falls almost everytime he walks- very vry clumsy.

He falls out of bed on a very regular basis- does not like bed guard on his bed makes him really panicky

He likes to have things tight round his neck- belts, strind very scary at times

Jammy - could be talking out of my bum here but if you can get across that he frequently needs help at night - you getting up to him to put him back to bed - then you should get mid - rate. It depends whether the panel think you do it more than would be usually expected.

I've posted to you before I think about our appeal.

Panel was pleasant enough, the medical guy was very nice. Guy from DWP (they don't always turn up) was obnoxious but the panel obviously thought so too and were equally horrible to him! At the beginning they basically asked me why I thought the decision was wrong ( how long have you got? lol)Refer to the written statement that they should have sent to you about your ds's decision. One of dd's consultants had sent a report that sort of contradicted itself so I put that right. Also I did a diary for dd's day which was very well received by the panel - we went through it together and I think it really helped them see how much extra time we spent on her.

I was on my own so it was quite nerve-wracking. I initially felt that it was these 4 people against me but really the panel were very open to my opinions and it really was OK. I think having someone with me, even just to sit on my side of the desk would have helped my nerves.

Went to the advice shop and have asked for them to represent us. The appeal date that was set fpor DT2 will now be changed as they cant represent us on that date.

Got results of DT1 DLA claim today(awaiting autism diagnosis) which was refused.

I so wish these people would just spend 1 day with me and live my life

Sorry I know there are many in worse situations than me
