I recently did DS's renewal claim for DLA. His original award expired Dec 2013 so I submitted renewal in September got decision by end September. The initial decision was for HRC and LRM as he had been on before. However I managed to get HRM and HRC after a reconsideration and on an indefinite award.
The issue is they will not backdate it. What they did was to run the HRM to start from the date his previous award expired as they were arguing that was the renewal date. I have counter argued that they have accepted that at the date at which I submitted the renewal claim in September and they awarded HRM based on that claim that they had accepted his needs had changed and hence award should be backdated to September. They are saying I have to appeal again to do this which seems ridiculous as I thought they automatically backdated all awards in this way. I am also reluctant to open it all up to reconsideration again as I know we are very lucky to have HRC and HRM indefinitely and I would be concerned about if they reversed that as they do seem to be somewhat disorganised and random (they lost his appeal form ).
Would appreciate any advice on this
