Changes to funding for 121

Ds is in Y5, dx ASD. He has had 25 hrs 121 since dx in 2012. Our LEA fund the top up hrs without a statement.

His 121 was recruited for him but quit at the beginning of the year. His new 121 spends a lot of time taking other children out, in other classes and even on school trips with other classes.

When i queried this i was first of all told it was to improve his independence, when i pointed out that it was having the opposite affect I was then told it is because the funding has now changed.

I have a meeting next week, and want to be prepared. I know there have been changes to funding but I am confused to how that means he now doesn't get full time hrs. His review was in October and the letter from the LEA states top up to 25 hrs.

The SSEN gives him 25 hours 1:1. Full stop. Funding is not your problem. Their problem. Don't get the two confused. if he's not getting the Statemented provision then say you will Judicially Review the LA.

He doesn't have a statement, our LEA fund the hrs at SA+ to reduce the number of statements.

This is exactly why you need a statement. I think you need to ask immediately for statutory assessment as the first part of the statementing process. Have a look at the IPSEA website for full details and sample letters.

Apply today for a statement today!

He needs a statement and you need to apply for one asap using IPSEA's website which is www.ipsea.org.uk.

If there is no statement in place this type of scenario you describe happens because the money is not ring fenced.

Do not get bogged down in funding issues; that is the LEAs problem and not yours to have to deal with.

Also I would think that this policy of theirs is unlawful as well.
