Just wondered if anyone has access to this piece of case law as I've just found out the LA will be relying on it as their main Tribunal evidence next month?

Yes the davidwolfe link contains some useful stuff, but needed more detail on this particular case. Can't for the life of me work out why the LA have cited it as evidence they may rely on at the final hearing though!

Is your LA represented by a firm of solicitors by any chance? There's one that seems to make a habit of quoting the same case law whether it's relevant to the case in question or not.

Lol, that firm litters their documents with irrelevant case law in an attempt to intimidate Parents who won't have access to legal databases. I understand this strategy is becoming more common.

How anyone in government can claim that parents can easily advocate for themselves and therefore have no entitlement to legal aid......

It really is beyond most parents ability and resources.

Unless SENDIST can be forced to publish an up to date case law list and explanation in lay terms. That would go some way to help, but then they'd have to acknowledge current system is unfair.
