Both after same sn place, help

We have been informed that there is a possible sn placement for ds4 which would be lovely. It is only a possibility and would be the final available school place in this school for 2006/07
Howevever, one of my friends is going to tribunal for a placement at the same provision. Does anyone know if the school is legally bound to hold a placement for a child pending tribunal or do places get offered to whoever is on waiting list first.

I feel like we are in a bit of a nightmare situation re ds4 and schooling.
