DLA higher rate care advice please

Hi, a few people have said that my son should get higher rate care (he is on middle) am assuming he doesn't get it because he is normally asleep by 10pm and sleeps through til 8? Any advice appreciated. Thinking about trying for mobility as he is four and doesn't receive it as it would help so much. TIA.

Hi HRC is only awarded if the child is up frequently during the night. The only mobility available for a four year old is high rate. To be entitled to this the child would need to be unable to walk or virtually unable to walk. You could also qualify if there is evidence that your child is severely mentally impaired together with extreme behavioural problems and already in receipt of HRC. When your child turns five you may qualify for low rate mobility which would mean that your child requires a lot more supervision than other children of the same age.

to get HRC your DC must need help throughout the day AND during the night. cannot remember how much/how long you have to provide care at night but if he sleeps through from 22 - 8 then you won't qualify for Hrc.

Unfortunately, that's the case. If your child sleeps during the hours that the family sleeps (typically regarded as 11pm-7am, but can be a different set of hours) then they aren't entitled to HRC.
