Stopping son from school trip

My ds is really struggling at school. He's just moved up from primary to middle school. He has a 27.5 hr statement but no diagnosis yet. He was assessed in the hols by the ep's and they came back and said it Autism or ASD probably SPD but further investigations needed.

He's hyper mobile and finds it hard to write. UnfortunAtly for him he is really bright and they have assessed him and stuck him in the top English group that expects reams of paperwork doing Angry I personally think he ticks the boxes for PDA and he is very very argumentive with the teachers/TA. Primary advised them to assign one named TA to be with him all the time, but he has a different one in each class, so no consistency.

He keeps getting sent to isolation (he actually prefers it there as its so quite so I think he is engineering this)

Anyway. - next year they go away for 3 days n a fun residential ( he did one in primary and was fine) and school have phoned me today to tell me they can't consider him for this trip because of his behaviour. I queried whether they could quoting how can they punish him for things on his statement ? Asking if the DDA stops them from excluding him. Basically they think he will be a Health and safety risk, even though I quoted he'd been ok at primary n exactly the same sort of trip. (This one is literally 10 mins drive away)

The trip goes Friday am and comes home Sunday pm so think they they can because its over a weekend ?

We left the phone call at a stale mate - he refusing me quoting DDA ...... Can they exclude him from this trip ?

Been working in my primary school today and spoke to a few teachers (he went here till he moved up this summer) and am rapidly coming to the conclusion this school is not right for him, waiting on call back tomorrow from his EP for her advice ....
