Very interesting case here

LAs and schools need to be much more aware of their legal duties under the Equality Act and the overlap between this and SEN.

This is not that dissimilar to one part of my claim against my Son's school. Just had the order of remedy, LA does not come off well. Local newspaper is not interested as it is very pro the local authority.

Interesting isn't it that the LA are highly criticised by the tribunal yet LGO has no such concerns and they can actually do something about the LA whereas the tribunal can only Order the school to take action.

The system sucks!

You are right

The LGO would be quick to say it can't act as a Tribunal BUT there is nothing to stop the EA informing the work of the LGO.

Indeed, there is guidance suggesting this should happen. Guidance which none of them have read. The just send someone to aan EHRC meeting once a quarter pretending the HRA and EA are uppermost on case invesitgators minds.

An Assit Ombusman wrote to me and said she had this guidance didn't even apply to them when it clearly did.

Yes mine did and she was the one who shut it down with a one page letter without waiting to receive the comments I had to make about LGO's service.

I don't think so, I live in the UK and took my son's school to a DDA hearing under the new rules. Three out of four elements of my claim were found to be discriminatory acts on the part of the school.
