Refusal to assess - AS/ADHD

We are currently awaiting our tribunal about the above. The LEA are refusing to assess and have called a witness from the school he attends to support them along with the LEA EP.

We have a report from an independent EP.

My question is, how will the respective pieces of evidence be used to decide on the refusal to assess?

If anyone can shed light it would be useful as we are trying to put the case together/understand how it all fits in? Thank you.

Do you have witnesses?

Yep so far the EP that did the independent report, not sure on others as the school are backing the LEA. Don't know if another person at the school would support our side.

Thanks SChmeda, we are going to need it. Just pulled up an old thread on here about academice progress and acheivement and a very useful quote from the COP about it which will help support our case.

sounds like they are going to try and say he is making okay academic progress and the support the school already providing is okay. are you getting any more reports done?
