A loophole in the "bedroom tax"?

Today's headline in The Herald. It's a Scottish paper so refers to "Scots" who might be able to take advantage, but I don't see why the argument would be different anywhere else.

It seems to be clutching at straws. The DWP say that they'll use the HA definition - eg two-bedroomed flat - which is generally upfront and transparent.
