tribunal - final date of submission of evidence - anything i should be doing?

got about 10 days before all the final evidence has to be submitted. slowly getting it all together but what else do i need to be doing?

do i just send it all in in a big bundle or do i need to write a case statement etc and if i do what do i need to be writing?

i am appealing parts 2 3 and 4. we have SALT OT and ed psych reports, he needs OT and SALt in the statement - no reports were done for the original statement. LA said they felt they were not needed. OT and ed psych reports state he needs specialist placement - school we want is a free special school and will cost no more than his current school place as he has a 32.5 hour statement. hes only in school part time due to anxiety. current school cannot meet his needs. as of yet LA have not offered an alternative school so have no idea really what school they intend on pulling out of the bag - so far their ed psych who is being called has not seen him so im expecting fun and games next week when they go back to school as the LA realise time is running out.

im intending on submitting all emails etc, have updated school reports which show the decline, got my OT going in to do an updated report on monday, letters from paed, letters from NHS OT confirming you cannot get sensory intregration on the NHS and lots more - the only evidence to date the LA have submitted has been an NHS OT report which agreed with ours.

i just have a feeling i should be doing something but not sure what - the working document is never going to be agreed as they wont allow OT into part 3 and no doubt will do the same once we attempt to include the SALT report. they are agreeing to nothing so i can see that this is going to tribunal

Yes, write a case statement but call it 'parent summary' or something. Flag up the docs and sections that make your points. Reserve one or two points until the day itself (although make sure the evidence for those points is included in the submission for you to refer to).

Expect the LA submission to be chaotic and an information dump of irrelevant stuff.

Write to school stating that you require a weeks notice for any visiting professional to see your child as you woukd like to be present and need to make necessary childcare arrangements. Make it clear that consent is not given without this.

I can't see it going to tribunal if I'm honest.

regardless what happens he will need OT and SALT in the statement. the LA are trying it on by putting it in part 6. however in part 2 which has been agreed it says that he needs OT to access all parts of teh curriculum so they are pretty sunk there i think. they have deliberately delayed which of course they deny, however in the LA file is a note from a meeting they held in june where they discussed my OT report and they agreed he would need OT but went and got their own report which wasted time from june to sept and the report was even worse than ours.

they promised autism outreach would go in one morning a week - never happened - she has now given the school 'strategies' only my version the LA gave me is 3 pages long and the one on the school file is one page so the one i was given was deliberately doctored to make me feel that he was getting support. she is meant to be going in to work with him 1:1 but has yet to do it - i am seriously now i knowthere are 2 different reports thinking about withdrawing my permission for her to see him as clearly i bet she will be doing it for the tribunal and its likely she will see him once. i have asked to be told taht shes a qualified teacher. LA refuse to tell me. tribunal issues an order saying it would be helpful for me to know but asLA refused have given time for LA to say why the refuse which is next week. I think i could argue that until i know she is qualified i dont think its in his best interests. he is signed off school in the afternoon, LA wanted her to go in and see him if i let him stay over lunch so as to not impact on his mornings as he is getting so little education. he has been part time since June - again LA done nothing. they are making an example of me i am sure.

so i will submit all of the evidence, all the emails teh LA have ignored etc etc. they also have a solicitor for the actual hearing, we cant afford anyone so are doing it ourselves

oh and noone from the LA is attending the tribunal just ed psych and OT plus their legal person which seems odd especially as will be argument possibly over school placement and costs etc but there will be noone there to answer the questions. either they are going to concede or they are scared to attend - the LA are also saying that there is noone actually looking after the case - hes the hot potato noone wants to hold
