Are LEAs allowed to email draft statements?

Draft statement dated and posted yesterday but has not arrived in today's post. The LEA say they don't normally email drafts because of my confidentiality - it's not secure. I asked whether I could give permission/waive confidentiality and they said they would check and call me back but I haven't heard yet. Has anyone else recieved the draft (or a copy) via email?

They just returned my call. They said they are unable to email but at going to fax it (is this the 1980's?) to the school where I can pick it up. Now I'm scared to read it Confused. Wish me and DS luck Smile.

I requested and received an electronic copy of dd's proposed statement, so it is possible.

Good Luck Keepon and littlekeepon :)

I wasn't able to have, and the LA were not able to send to other authorities an electronic copy of the draft or statement. However they were able to post the draft statement to other LA's.

fingers crossed for you

There is no rule - it's just common sense. They can password protect it. My LA do. It is far easier to have an electronic copy for changes anyway.

StarlightMcKenzie · 17/10/2012 11:00

Some LAs are using this tactic to discourage ammendments. They think you'll give up if you have to type the whole thing.

Email them requesting a copy. When they email back refusing, ask for their policy document that states they are not allowed to.

idiots.

moosemama · 17/10/2012 11:03

They emailed ours when it didn't arrive in time for an important meeting and have since emailed it to PP at my request as well.

Good luck, hope its a good one.

Ds's and dd's were emailed in fact ds's was emailed to my solicitor and the school as well.

Picked up the draft - they are having a laugh. Mainstream with 10 hours support which may be individual, small group or whole class. This is less than he had on SA+ ffs. Now to scan it and send to Advocates.

My LEA told me they couldn't e-mail and sent by post.
I scanned it converted it to word, amended it and sent to back to them by e-mail. They proceeded to send my things back by post until it got near to the tribunal date and then they miraculously started to use e-mail again.
I have an e-mailed copy of the final statement as well as the hard copy.

Lougle · 17/10/2012 11:40

Oh dear. Check with them if there is a misunderstanding with wording Wink Some LAs write statements which express what they (the LA) will give in addition to the 15 hours they expect the school to provide, as that's what they expect under SA+.

That would make it 15+10=25, so all classes covered.

If that's the case, then all they need to do is reword the woolly parts, and make it clear that it's 10 hours in addition to the 15 that the school would provide from their own budget.

StarlightMcKenzie · 17/10/2012 12:12

Wot Lougle said.

Sorry though. I guess it was kind of what you were expecting but you still get that gloomy feeling don't you?

StarlightMcKenzie · 17/10/2012 12:14

Our parent partnership told me that I really shouldn't appeal the contents of the statement as I was lucky to have one at all given all provision within it could be given without a statement!!!!

That has to be one of the funniest parts of my journey - on reflection - (it so wasn't at the time).

Not over yet. Since the submission DS has been assessed by GOSH APD (severe APD), Daphne Keen (highly complex neurodevelopmental disorder with 7 elements including ASD) and SALT Margo Sharp who confirmed the ASD diagnosis. Both DK and MS have stressed the unsuitability of mainstream and recommed SS.

I know that the LEA are aware of the assessments through EOTAS and the middle school DS is unable to attend but I haven't formally submitted them (and so they can't cut and paste) and so they have written the draft as if they didn't exist and focused exclusively on dyslexia, working memory and self-esteem. Even so it is bad - wooly to the extreme. But at least receiving the draft takes us out of total limbo and we can proceed to the next stage. I'm pleased now that the reports did not arrive in time to submit earlier as it will give an excuse the pending about-face which might otherwise look very much like incompetence. On the other hand, if they stick to their guns, they will look incompetent in front of Tribunal.
