Hello,

As previously posted on here, I have appealed against the LAs decision not to assess my son's SEN. The deadline for additional info is Monday.

I have just received the council's final info pack. It includes a sheet listing correspondence between us but has no mention of any of the reports that I submitted by e-mail over the last couple of months. Should I e-mail them all again to be on the safe side? The e-mails also went to SENDIST.

Has SENDIST definitely got those reports?

Has SENDIST got a copy of those emails to the LA? (to show that you submitted them to LA)?

Sounds to me like common LA tactic of not agreeing SA on basis of 'misunderstanding/confusion' in order to delay process beginning and will probably change their mind shortly.

If so, get their incompetence recorded and ideally acknowledged by SENIST in order to get an agreement for expediting and bringing forward tribunal date when you're appealing contents.

I have the automatic replies from SENDIST stating that they have received my e-mail each time. I have also printed out each of the e-mails after I sent them which shows date and time sent as well as who they were sent to.

Well, I wouldn't bother then tbh. It just complicates things sending them twice.

I would reply to the LEA saying " Thank you for your pack. It seems you have missed out the following........ list it all -attach copies showing when it was sent etc" and CC SENDIST. It will show the LEA that you are going to show that they are time wasting/being incompetent - whatever spin you want to put on them ignoring your reports and this may tip the scales in your favour with the LEA "reconsidering" .
