urgent advice re deferring and 1 to 1 funding please

DD has GDD and Autism have deferred from school as fighting for SN school place so she is still in pre-school. LA now saying she is not entitled to her one to one funding because she should be in reception.This was all supposed to be looked into in May after her review meeting and nobody said there would be a problem and sen caseworker just emailed before summer hols saying for school to re-apply for funding.
Is this correct please ?
She has 25 plus 5 statement
Fuming does not cover it !!!

I don't know the legal side I would pull their bluff and say, fine, give her a reception place but prove you can provide for her educational needs first

Stop talking about funding. Is she entitled to 1:1? If she was in reception then what is so better resourced about preschool that it is no longer needed?

lisad123 i dont know either am trying to get hold of solicitor dealing with tribunal.
Starlight she has been entitled to 1 to 1 for the last year and half for the full amount of hours . Sorry am pretty upset and don't get your second question.

That isn't a question for you but for them. Either she needs 1:1 or she doesn't. What is so superior about her current placement that no 1:1 is needed? And if it is needed, then what is the purpose of the additional beaurocratic and having to jump through hoops already jumped through.

Ok thank you i follow it now . So her caseworker is supposedly looking into it and my solicitor is going find out what is happening too .
I know there was going to be changes around the early years process but nobody warned us of this.
I know your experienced on here and regularly read up but is there anything else i can do please ?
Though her pre-school would try to keep her safe , on paper she is left to he own devices now .
