Appealing for SS place

Hi everyone i need some of your expert advice please. Am about to appeal for my dd for a SS placement have been kept waiting 4 weeks for an answer from panel and got a no.
S.E.N caseworker says wait for the statement tribe released then I appeal about the part that says to be reviewed ?
Would it be better if I got my m.p involved or even take legal advice ?
My dd is falling further and further behind and from what I understand there are places at this SS but it's to do with the government releasing money.

The local authority manages its own budget for children in its area. They will have had their central funding cut, as all councils have, but that is not a reason not to meet their statutory duty to provide an appropriate education.

Legal advice would be good. If you are eligible for legal aid contact a firm like Maxwell Gillott who specialise in SEN. Or if you don't qualify try IPSEA which is a charity and provides free advice (but you usually have to do the work yourself and they just check it)

You can just appeal Part 4. But its usually better to appeal 2,3 and 4 as by the time you get to tribunal there are usually bits of 2 and 3 you want changed and once you get advice you may be able to improve 2 and 3. There have been cases where a tribunal has not been able to name a school because Part 2 and 3 did not allow e.g. if the school could only accept children with certain problems and those were not listed in Part 2 / 3. So its safer to appeal the whole thing in case the Tribunal want to add evidence in 2 or 3 so as to make it easier to name a special school in Part 4.

You can also ask your MP. We used to have a helpful MP here who knew a lot about SEN, but the new one doesn't...
