Hi,

First time poster and couldn't find anything similar...

I have a question about SEN, tribunals and all that stuff relating to our statemented child who is due to go up to secondary school in September.

Does anyone have any experience or knowledge around the situation regarding the consideration of post 16 needs on transfer to secondary stage of school? That is, if it's pretty clear the child will need to stay on at school, can that be considered in his needs and at a tribunal? It seems not and that seems stupid but I wanted to check. I'd be particularly interested in any case law or possible search locations.

Thanks

I don't know the answer to your specific question, but just wanted to point out that (as it stands at the moment) from 2013, a child will not be able to leave education at age 16 unless they have specific training, course or a job to go to - they will have to stay on in education for an extra year (not sure what happens in schools where there is no 6th form - assume child has to sign up at local college). Then from 2015 they will have to stay in education until 18 - unless they have something concrete eg apprenticship, course, job etc to go to.
Not sure if that makes any difference to your question.

I suppose that you would need choose a secondary school that could meet your child's needs until 18. Our son went to a school with an A levels only 6th form and left at 16 for college, but even if we'd known that he wouldn't be able to do A levels we would still have chosen the school.
Everything will change as bigbluebus said, so it wouldn't necessarily help tp find out what happens now.
Don't suppose that helps really.Have you tried IPSEA?

Hi Call the department of Education and Skills and get them to send you a copy of the SEN Code of Practice - Chapter 6 - page 59 Identification, Assessment and Provision in the Secondary Sector - this may have something, also page 130 9:51 - Transition Plan for year 9 - not sure as we're only at year 3, but may be worth looking into.
........going through this riveting read all effing day - bloody nightmare!!
