Another Refusal To Assess

Hi. We had a refusal to assess in March and appealed. At our meeting with the LA and PP in April we were advised to get the SENCo to send in certain information and to ask the SEN panel to review again as his most current levels indicated regression.

I have just received a letter from the LA again refusing to assess and this time saying that my child's achieving WELL ABOVE the levels for assessment. (He was doing so badly in his English mock SATs that they decided not to enter him for the real ones).

This is a huge disappointment but at least we have the tribunal date already set - even if it is months away.

I have asked the SENCo for a copy of her letter (where did they get the idea of being well above?).

Have left a message with Parent Partnership asking for a call back.

I'm wondering what else I can do?

Ask the LA for subject access data then you should get all that has been submitted.

Ask them for the criteria and levels for which they consider him to be above.

There is no national 'level' of sats results relating to 'when to assess'.
There is only 'adequate progress'; what constitutes it will vary for each child.
