Statement and OT input question

Independent OT recommends that ds needs input from NHS OT.

School are saying they will refer to NHS OT.

I already know what NHS OT will say, as i self referred ds "under staffed and only dealing with the most severe needs ie children who cannot walk etc"

Ds doesnt have a statement, but if he did, would NHS OT be required to provide the help by law?

If you had it specified in part three it would have to be supplied and if NHS not available LA would have to fund private OT in its place.

Thanks Insanity, that is what i thought, just wanted to make sure (although i wasnt aware of private OT bit)

With regard to OT recommendations school said they would be happy to follow independent OT recommendations, providing NHS OT could supply. (yet they didnt support my statment application and i lost)

Im now trying to think of ways of approaching school about this.

Should add what school are saying is conflicting. In a letter to my solicitor pre-tribunal they say they would be happy to follow independent OT recommendations, providing NHS OT could supply.

During Tribunal they stated they are already meeting ds's OT needs, by using other methods.

Also after Tribunal they wrote to me saying they would be happy to make a referal to NHS OT.

Any ideas on how to approach school about this?
