OMG at LGO and LA

You know when you think these people have hit a low beyond which they cannot fall?

It's never true is it?

I have been pursuing the LGO for info from DS's file. They relied on an exemption initially under s 31(4) of the DPA.

I challenged this and they have now released further info - redacted.

Most of it relates to my 'vexatious' determination last year and most of it we already have (and actually sent to the LGO) so why the hell where they refusing to disclose? Could it be they have not actually read the submissions we made?

Anyway, the delights within the documentation we hadn't seen where some astonishing allegations passed on second hand from redacted persons (presumably an Ed Officer to someone in their 'governance team') in support of a determination against me.

It is suggested that this person went to DS's old school for another unrelated matter and the WHOLE school and ALL the children were being affected by me and staff were planning to leave and staff could no longer do what they wanted in the classroom etc. This was turning a happy school into a sad school Sad

It's really outrageous, distressing stuff.

This outstanding school with a teacher who is a national leader in education couldn't apparently deal with it themselves by talking to me or by telling me that they knew what to do so I should butt out.

They had to sit on their sadness and cry to the LA - make the bad lady go away.

What a croc of shite!

Oh and then mention of SLT doing the same is made.

Oh and of course, it is then suggested that they MIGHT WANT TO RAISE THIS AT TRIBUNAL!!!

What a bunch of low life scum and what are the LGO doing covering for them?

The LGO tell me that they are 'fully aware and conversant with the law" but that they "do take a view on the reasonableness of a Council?s action".

The reasonableness of failing to arrange provison which is a strict legal duty that has to be performed? Is their argument really that they look at how reasonable it is for a council to break the law? This is getting more and more bizarre.

Additionally, it seems 'reasonableness' can be established very easily if five months without some provision is acceptable based on ......no explanation at all??

Oh, and after raising the delay in removing my vexatious ban with the LGO, I suddenly get a snivelly email from the LA saying sorry for not reviewing my vexatious ban, and sorry for not saying sorry.

I cannot believe this is not the result of LGO prompting to head off another complaint.

At the same time s I get the LA email, I get an email from the Ass Ombudsman saying submit what you like, we know the law.

Oh and the same idiot who has now twice investigated my complaints and who has twice misapplied the law will deal with any further questions.

Yes, that is fair.

Perhaps you will, I have no idea. But you sound a long way from it yet.

No I didn't think I would uncover some great truth but the law is the law and this is a body which is controlled by law whether they like it or not.

My mental health is fine thanks and this is not a hobby. I am simply trying to enforce the law.

I could walk away and think 'well now I've got a good school or provision for DS who cares?'

But the legal case will be made against them and it will be pursued as they are., unquestionably, wrong on the law and the law is, at least, something that I know and I will use it against them.

I am not doing this alone. I will be supported and I can let you know the groups and individuals supporting this if you PM me.

I was merely trying to share continued incredulity.

I suppose that is what I meant. That your DS' future does not depend on this and you can separate what you are doing from real life in a way. It would mess me up if I couldn't. And I'm not criticising you btw. I'm your biggest fan.

On a talk board however it is hard to get a feel for the emotional aspect and watch out for each other. I have often found myself giving information or ideas bluntly as the next step can be so obvious to me, but forgetting hoe frightening even contemplating what I suggest can be.

And tbh, what you are doing is fecking frightening, in what you are taking on and what you are uncovering.

I suppose the best way to explain this is that Moondog can get a real sense of satisfaction in advising us here and pursuing her ABA consultancy because she can help to make things better after her awful experience.

Not to sound too pompous, but I became a lawyer to work to protect the individual and his/her rights from abusive state action. I took years of crap being a criminal lawyer and doing human rights work can be equally challenging.

If I can use what I know to do something, I must do it.

I spend my life at the cutting edge of law-making - I know that sounds pompous again but it is true. I know how human rights work and how the public law framework operates. I have advised counsel on many, many judicial review challenges on matters of public law and human rights at Court of Appeal and Supreme Court level.

I can't walk away. They will have to prove to me I am wrong. I dare them. Use the law and argue that with me - go on.

I am angry though. Very angry that an oversight body should get this so wrong and that Ass Ombudsmen on fat salaries can cover things up and not take legal advice when they clearly need to.

I hasten to add that my experience with the LGO on another matter was entirely different. I don't know what it is about SEN and these complaints but these people are ignoring their obligations to vulnerable children and it is an absolute disgrace.

Makes total sense, isn't pompous and is an inspiration - honestly! You've pushed me to follow up LGO complaint number 2 - I agree, we shouldn't let them beat us.

As you say, those that know things can help to change things.
