I need to share - DLA

DS3 is deaf and ASD. We were awarded MR Care and LR Mob. I contested it, and was told to write a report first just in case it needed to go to tribunal. Anyway I wrote the report last weekend, sent it on Monday. Phone call today to go through some points that they needed clarification of. Upshot is that we NOW have HR Care and Mobility back dated to June of last year! I am ecstatic, as I was so sure that they would shoot me down in flames and stand by their original decision. ?

fab news! dont forget to tell the tax credit office as you are given a higher allowance for higher rate, and as this has been backdated they might honour it backdated, but will from 3 months ago if not.

Mummytofive - explain please??????? I was on HR for Care years ago for my DD, I never did anything re. Tax!

if you get dla for a child, you get a disabled child tax element added onto your child tax credit, if you get higher rate you get this plus severe disabled child element. it is obviously based on your family income, but ours jumped from getting just over £300 a month, before dla awarded, to just under £800 a month after ds was awarder hr dla for both mobility and care. But you must delcare you get carers allowance as this is taken into account. To be honest, I phoned the tax credit people as I was worried that we were getting to much money as we were getting the dla and carers to find out it ment we were entitled to more. It is def worth a phone call, it can usually be back dated 3 months but i think they will look at it if the dla is back dated. Is this clear? My lil ones are screaming at me so I am typing quickly!

Mummy I am unsure as DH earns more than £55k (but not much more, just incase u all think that we are uber rich - I wish!). I thought that there was a limit that you could get credits etc.? I don't know. I have 4 kids, only one of them is fine the other three are deaf, Aspergers and deaf and ASD. I will call them on Monday. Thanks. Smile

Great news re DLA for your DS3 Sallybear. Regarding tax credits I stopped getting the minimum (£500 odd pounds) last year when there was a change to the maximum you could earn. Once my income hit over £50k even with 3 children you do not get anything, so you do not need to worry about tax consequences on the tax credit front.

thats brilliant news. Sallybear, you should still get the disability rate of tax credits, even on that salary. Its worth asking anyway.
I have two ASD children and was still getting disability part of tax credits on 45k, but not sure what the cut off is.
