hi, i am a lurker but have a question now :)

DS ( autism) wil start school (reception) in sept. we are just waiting for his statement to come through.

we have a small aba programme (15 h) running at home and it is working for DS. we will probably try to push for aba via statement. my question is: if we have to go to tribunal ( seems very likeky from what i read on here), what are the timelines? what happens if we are still waiting or a tibunal date by the time he starts school? he is quiet severely autistic and needs a lot of support?

you have to appeal within 2 months from final statement. tribunal dates are about 6 months after appeal is registered.

in theory they have to implement the statement even though you are appealing it so would start whichever school is named on the statement. However no legal obligation to go to school until term after 5 so you could poss delay start until after tribunal

Bear in mind you usually have to prove both ABA works and that the LA provision does not work it, which means you have to usually try it just to show it will fail.

is he in mainstream nursery now? do you have evidence not working or will you have this evidence within 6-8 months?
