I really dont know wether to say anything, they see alot of me and I dont want to become one of those parents that always make a fuss. I like the teacher but seriously worried. School has just been put on "notice to improve"

I agree with you, teacher should have taken action to stop them, sounds lazy to me. You could ask in aibu, but you never know what you'll get there. Why don't you ask in the teacher section and get their opinion?
