Note in Lieu help!

I have been issued a note in lieu of a statement and am meeting with the LA on Thursday as I have rejected it and want a statement. The reason they have given is that
*'s needs can be met within the resources available within a school or similar setting that can deliver the national curriculum. The officer has also told me that he is making good academic progress (he is but could do better if his learning difficulties were recognised and he got support for them). He has Aspergers with the associated learning difficulties of slow processing speed and not great working memory (very spiky profile). I need succinct bullet points to back up my reason for wanting a statement for him( am meeting with the LA officer on Thursday). They have referenced schools report (who recognise diddly sqaut) and completley ignored my advice (which I spent dayyyys putting together) any advice appreciated.!

Cancel the meeting and fill out a SEND tribunal appeal form and send it off.

As above - a friend of mine just got her statement request accepted by tribunal yesterday.

Reject the note in lieu out of hand, they are truly not worth the paper they are written on. Your son needs the statement, LEA are just spinning you a yarn.

Would appeal to SEND asap and cancel the meeting.

Is it not worth meeting with the LEA just to hear what they have to say?

You can completely disregard what they will tell you (you will not get a statement), but you may get some idea of what their angle is as to why you will not get a statement, which may give you an idea of how to tackle any additional info you want to include in your appeal iyswim.

There is nothing to stop you applying to SEND before your meeting with the LA.

If helps if you can bullet all your main points as succinctly as possible, apparently panels hear up to 12 applications at a time, they don't read everything especially if there is lots of paperwork etc. If you can bullet to show the school are not providing for your DS that's even better.

DS had a note in lieu - nothing happened. We appealed, the NIL became his statement; not brilliant but we didn't have time to appeal. The school's attitude changed where the NIL gave him no additional support the statement did; unfortunately too late.
