LA unlawful refusal to pay increased fees.

Apparently Surrey LA is refusing to pay increased school fees for 2011 -12 for statemented children in independent special schools. Also it is understood they are refusing to pay exam fees and any increased fees for therapy provision. As a result there are a number of distressed Surrey parents of children worrying whether the placements are in danger.
This may well apply to LA's in other counties.
This is unlawful on the basis of various Education Act 1996 provisions.
The school named in the child's statement is the school Surrey must pay for regardless of fees increases.

Following very helpful responses from parents and schools, SOS!SEN with some parents has decided to pursue action against Surrey and a first solicitor's letter has been sent. In the event that no satisfactory response arrives, a pre action protocol letter will be sent leading to a claim for Judicial Review against the authority.

Surrey is not alone trying this 'refusal to pay increases' strategy!
