DLA response. Appeal?

DS just been awarded low rate DLA. They do not seem to have considered his night waking (2-3 x a night) for over 30 mins each time. Is the appeal process worth trying?

As a first step you could ask for a "reconsideration" (it used to be called a review) rather than an appeal. This means someone else will look at the application and make sure that the original assessor has done it correctly. Some people think they are a waste of time (and I've never done one) so you might benefit from some independent advice (CAB, Carers Centre)

Even if you ask for a reconsideration you can still then go to appeal.

The really important thing is that you really need to show extra evidence that you havent already included in the original application. So letters from any professionals etc. Do you keep a diary of his night waking - showing how often it is and how long for each time? You could photocopy and send that too.

Definitely worth doing. A friend has just asked for a reconsideration and has had her rate changed. I went to appeal and also was successful. Go for it.

Does DS take Melatonin? It can be prescribed by the Paed, doesn't really work for my son but I used a copy of the letter stating that he has it as evidence.

I won on appeal after a reconsideration was turned down so it's always worth trying. All the best Smile
