How long till tribunal

Hi

Once LA have finalised statement, how long will it take for a SEND appeal date to come through is it a long time, I think I heard someone quote 2o weeks, but thats a long time, so not quite sure it is accurate.

Also how likely are the LA to agree to expediate a hearing?

Darn this process is so frustrating and seems really long winded

When I sent my appeal in, it took a couple of days for SEND to register and then I was given a date around 5 months from then.

You can apply for an earlier hearing if, eg. your child is not attending school etc. They will write to the LA and try to agree a date.

The breakdown of the tribunal timeline is here. They usually expect it to take at least 4 months, as they allow 16 weeks to submit evidence.

At the moment it seems to take about 5-6 months. If it's a secondary transfer case, it should be sooner.

I would be careful about trying to expedite the hearing, I found the waiting time was pretty busy in terms of gathering evidence and researching etc. And it would have been difficult for us to find another date when all of our witnesses would be available. But if none of these apply to you, an expedited hearing would at least allow you to get it over with and get a decision sooner.

We were given an original date of about 5 months later within about 2 weeks of registering our appeal. When we then asked about expediting the appeal we were told to approach the lea ourselves directly to see if they were prepared to agree to an earlier hearing - this would be at earliest about 3 months after first registering appeal because they have to allow a few weeks at least after lea's original deadline to respond to the appeal.

Took us 10 days to receive a response. Tribunal was set for just over 6 months from submitting forms. We had asked for the forms before receiving the final statement though (knew it wasn't acceptable), so forms went off the same day.

We lodged appeal in April tribunal date was October.
As far as i am aware Tribunal do not sit in August.
