statementing/no education provided at moment

my son HN is ASD and needs to go toa special school because he is very emotionally behind and has sensory problems he also has a learning difficulty and was bullied at first middle school we changed middle school still being bullied and then has had many days being sent home early and three times been suspended now they are after 8 years as i dint know my rights are statemnting him his ed psy was very biased and weve tried to get this redone or all the many areas inc his learning difficulty added so far to no avail he was being home tutored and they stopped that without prior talks or even a phone call b4 xmas we had a meeting left messages ect and the incusion manager is ignoring us as she hasnt a clue where to send him but says they cant aford the home tutor hes under CAMHS now as he was threatening his life and keeps trying to run away and hardly sleeps ive been told by parent partnership they can see this going to the panel and then possibly tribunial i feel at my wits end ive just written to local mps councillors n today to the education secretary im so upset

I'm so sorry you're having such a hard time at the moment. I can't offer much advice as I haven't been in your situation but I'm sure someone with more experience will be along soon.

Look at this IPSEA you can ring them and ask for advice. Your child should be getting home tutor. They can't refuse this on cost grounds they have a legal duty to provide an education.

Contact the Local Government Ombudsman - they may be able to help - make sure you tell them your child is out of school now and has been since before Xmas.

Where are you up to with statementing?

we are waiting for the first draft but this will almost deffinately say from our convos with them mainstream but with a unit the units in mk are where your child still has all lessons in the normal classroom but as hes emotionally about 7 and i know he is unwell at moment and threatening to run away (hes tried it a few times) this obviously scares me we will apeal of course and go to the panel then trib if we have to. the ed psy report was so bad we may be complaining about the ed psy personally as she no longer works for the ed dept and wouldnt listen to anything we had to say or his tutor who came with us she left so much info out and as he wasnt at school didnt check his handwriting and this is a major problem for him ive been looking at IPSEA and will prob end up resorting to getting an educational solicitor involved but thanks for the local gov ombudsman ill check it out

bailey, First lots of sympathies as it sounds like a very worrying situation for your family.

But secondly and more importantly, the law is on your side. The key document is:

The key to accessing the help described here is a referral letter from the consultant he is seeing at camhs describing how his medical needs (anxiety, asd in an un-asd friendly school environment, stress from not having his sen met in that environment)mean that he is not fit to attend current school setting and he needs home tuition support while his needs are being assessed and until a suitable setting to meet his needs is found.

ty Pinkorkid ill prob read that before the meeting with head of ed psy and their dr tomoz and prob take it with me originally he was given the tutor temp as they didnt think the PRU was the right place temp to send him so PP asked them to provide a tutor so they reluctanly agreed the idea being after the hash the school had been making handling him too much hands on by male teachers he doesnt know and physical retsraint and a ta in his class who doesnt understand him at all (he was suspected ASD or asp at time) and peers verbally and psycically bullying him his teacher making him stand in the hall being made to go without playtime or having any golden time basically punishing him for their own inadequacies after 3 exclsions ect and his threatening his life and trying to run away (extreem stress reaction) i couldnt get him to go back as he didnt feel safe and protected tba i didnt think he was either the tutor was lovely and got so much more out of him and came to see the ed psy but was when she tried to explain his emotional and education insight told that it wasnt needed SHE was the profesional ,I hope tomorrow they will agree to a second but i doubt it, i feel if they have their way he will do them a favour and end it all so 1 less to bother about because no1 is listening any more than they did b4 he was diagnosed (this is common i know)But all along from day one with the tutor she said it would take months not days for her to help him and turn Harrys opinions and fears into trust as this was lost all i can see is him being at the mainstream with a unit (alllessons still in the classroom) their is 1,700 pupils there and 9 school blocks (harry likes to run away or run n hide) and i know someone who has a child with adhd there who has many times been excluded and i went to visit and felt it totally unsuitable he wouldnt even be able to cope he struggles in a class of 30 with ta and 1 teacher he takes 6 months to settle at all let alone in classes where he has so many more different staff and pupils for each subject he will end up spending more time excluded and being sent home and not accessing the education at all aggghhh its making me crazy and i have a disabled husband im carer for and two teens as well beam me up scotty
