ADHD and DLA

I applied for DLA in July 2010 for my ds.

In October it was declined so I asked for a reconsideration as they had not received his psychiatrist report and school had written but had only known him for 3 weeks.

The recon was also turned down, although they said I had till 20th Dec, they made their decision on 10th Dec.

I received the appeal pack today, they have spelt my name wrong throughout apart from a couple of times and still not included the phsychiatrist report even though they received it by email and this is confirmed.

Should I go ahead with appeal? I am losing the fight

ds has adhd, ocd, attachment difficulties, anxiety, anger issues, sickness phobia.

Definitely appeal. My DS has CP and was turned down for DLA. We had to ask them to reconsider and appeal 3 times at which point they awarded him higher rate care and lower rate mobility.
Definitely check what school has written. This was the reason for the second rejection in my DS's case. Support worker had written the report and basically said DS had 100% access to every aspect of school which was a)not true and b)he had 100% support awarded by his statement so anything he did access was with 1:1 support.
A good friend used to work in the council in a role involved in DLA applications ( I think he represented the appeals) and he told us that a lot of the time the first applications are not read and simply accepted or refused on a quota basis

Ah thanks, so will they reconsider first now they have sent the documents to appeal court? or have they already reconsidered again?

no not at the moment, CAB was shut today. I will call them Monday.

I am going to try to get a representative, but was starting to feel a bit beaten down by it all.

Just an update, not found a representative yet but I have decided I am going to fight it - thanks so much for all your support
