how long should a Case Statement be?

Is their any guidance on internet how to write it as mine is pants.

Not sure - I wrote three sides for my initial reasons for appeal' and then a further six sides when the LEA had responded to the appeal so I could address all their ridiculous arguments. A lot of the case paperwork was then reports from various professionals. You could maybe look on IPSEA's website to see if they have any guidance. It took me a while to get going with mine. My first bit wasn't that great, but once I had seen the LEA's response it was alot easier as I knew what areas to focus on.

cansu how did you get your LEA's first before writing your Case Satement? I thought both sides have 30 days to put in their case statements and you get them the same time?

I have written quite a bit 6 thousand reasons for appeal (not sure I have just put to much in their) and 11000 so far with 20 minute video (needs transcrpt so more words!) and of corse the reports. Feel I have to write everything...just incase they dont except late evidence!

Will look on IPSEA...good thinking!

Is it for refusal to assess? IPSEA has a refusal to assess pack on their website which has some guidance.

I put in my case statement when I lodged the appeal and then the LA had 30 days to respond with theirs. I was able to add further evidence after that but my LA's response was so poor (no real arguments and no response to my own case statement) so I only sent in further reports, but didn't add a further case statement.

My refusal to assess case statement wasn't too long, a few pages I think. When we appealed against pts 2/3/4 it was over 50 pages because we were practically asking for the whole statement to be rewritten.

Was just looking back at paperwork. I put in initial reasons for appeal, then when the tribunal sent me document called 'LEA Response to Appeal', I put in another document with all my further information. This was a much meatier document because I was able to address their main point which was their assertion that my son had made progress at his lEA school and I also put lots of reports, past annual review documents in which I had referred to. Maybe I should have put this in my initial reasons for appeal but in some ways it was probably advantageous as the LEA had by then shown their hand and given me something to work on! Also not sure if rules are same as when I did my case. This was about a year ago??

Yep cansu rules still the same here, I honestly cant remember last tribunal and I dont think LEA replied with a response...if it was it was one pageGrin.
Sugar its P2/3/4 so reasons for appeal I think I went through whole statement and wrote the lot...maybe I should keep something back....maybe the school?(it's ind)

I was advised to set out my cards with the initial case statement, in the hope that the LA would look at the (huge) weight of evidence and decide not to fight it. Unfortunately we did have to go right through to tribunal.

If you want to name a particular school you shouldn't hold that back, SEND will want them to confirm they have a place and have the Ofsted/prospectus/cost etc so they do need all that information from the start.

Do you have an idea of what the LA will argue? What have they said when you've had meetings/calls with them?

The rules changed in Nov 2008 so the rules won't be different from cansu's tribunal. It's fairly easy to send in late evidence up until week 16. The timeline is here.

thnks sugar for that:) Nope they aint a clue...want to surprise themGrin I have been before but have forgotten...iguess its like being in labour...
I tried to meet with them but the manager isnt free to chat to soo their you go!

they will say resourse base I guess...but ds wont cope in one (well there one). I will also save them money as willing to reduce the aba that tribunal ordered 3yrs ago ...don't know if I'm crazy doing this but gotta try something as MS is really bad environment for ds he is really suffering
