SEND Tribunal issued warning to LA

I am in the process of a refusal to assess appeal the hearing date being in July. Today the tribunal issued the LA a Rule 8 (2) warning. Specifically for not including the child’s views in their response, and ordering them to do so in the next 7 days or they WILL be barred.

Does anyone know how common this is? I am hoping the tribunal has been looking at my case and noticed that the LA filed a late response, with factual errors and a data breach, and also had to submit the court pack 3 times due to missing documents and errors.

I’m hoping this means the tribunal is concerned about their overall conduct.

anyone have any knowledge or experience? Does this happen a lot?

It is common phrasing when LAs haven’t done something they should have.

Just so you are aware, just because SENDIST says they will be barred, doesn’t mean they will be. Even when they are, they are often reinstated.
