Emergency review help

Morning, my first time posting, we have requested an emergency review of my sons ehcp due to him having to be restrained in school, he suffered with ebsa jan-sept last year and has been back on a part-time table since, they have upped it and its cause distress, he is autistic has an extreme pda profile and is suspected to have adhd also. He was restrained because he was lashing out and throwing things etc (he is just turned 7) his ehcp states he needs to build relationships with people and trust or he will lielly end up with ebsa again and this is what has happened. The school were aware that it could happen if they had to restrain.

Anyway my question is, what should I be preparing in advance? Ive not had an emergency review before and the ehcp is very new (jan this year) I feel im out of my depth but I know that he can not cope in this school anymore and he needs a specialist provision (he is in a nurture provision 3 adults and 7 other children) thanks

If the EHCP was finalised in January, depending on when in January, you might still have the right of appeal. If you do, appeal now.

Emergency annual reviews follow the same procedure as annual reviews. So:

  1. Updated advice and information must be circulated at least 2 weeks prior to the AR meeting. Although if they are ready, some parents decide to forgo needing 2 weeks, especially for early reviews.
  2. Then you have the AR meeting.
  3. Within 2 weeks of the AR meeting, a report must be circulated.
  4. Within 4 weeks of the AR meeting, the LA must inform you if they propose to amend or not. If they are, they must send the amendment notice/draft/notice of amendment/proposed amendments (whatever the LA/you want to call it) at the same time and you must be given at least 15 days to comment on the amendments and state your preferred placement.
  5. Then if the LA is going to amend, they must finalise within 8 weeks of sending the proposed amendments, so max of 12 weeks from the AR meeting.

Before the meeting, it will help you to go through the existing evidence, the updated advice and information and the current EHCP so you know what needs amending/improving.
