Not on SEN register

Without going into too much detail, my child’s secondary won’t put him on the Sen register, does anyone know any reasons why this would be in terms of, does it benefit the school in some way to not have him on there? I can’t figure it out at all.

He has autism, ADHD, learning difficulties which are recently diagnosed and other medical issues. I just can’t fathom it. I recieve high rate DLA because of his care needs but it just doesn’t seem to be translating to school and he isn’t a student who masks an awful lot either. He’s in remove an awful lot, bottom sets and falling further behind. I can’t get an EHCP because school won’t apply for additional funding and aren’t doing all they can to support him. How do they pick and choose who’s worthy of the extra support?

Because some schools are rubbish at supporting DC with SEN and think if they don’t, DC’s needs will magically disappear.

Request an EHCNA yourself. You don’t need the school’s support. You don’t need them to have applied for additional funding either. And it is possible to get an EHCP even if the school could do more but won’t.

Have they said why they won't put him on?

Apply for an EHCP yourself.

I feel would be good to raise a SAR with the school

Hi, thanks for the replies. I have, twice now. The last one said not enough evidence. I have a few days left to appeal. I have SEND IASS who have given me a case worker now. They aren’t happy and said he should be on the register. They’re going to help me now. But the school said they only put kids on the register who have prolonged support. My requests for the past year and a half for support for him have been ignored. It’s almost as though the think I’m making a fuss over nothing. He had an awful first year but they gaslit me in the meeting I pushed for and said they weren’t aware there was an issue with him. It’s absolute rubbish as I’ve made them very aware/forwarded paperwork. I did an SAR and the proof is in all the emails the teachers have sent. He needs one on one to get started, can’t follow instructions, is doing no work, is falling further behind but they ignored me when I brought this up in the meeting and said everything’s fine. Primary school refused an SAR because they said there’s too much work involved. I’m at a loss and can’t figure it out. I feel I’m failing him and there’s nothing I can do.

Appeal.

Be careful with SENDIASS. Some are good but too many repeat the LA’s unlawful policies.

If you want the SAR from the primary, have you complained to the ICO? Although if DS is Y8 it won’t play a huge role in an appeal.

I will thanks, just gathering the additional evidence I have now.

When you say unlawful policies, what do you mean? This is all so confusing to me as it is.

No I haven’t complained, maybe I should. I think the reason I fixated on this is because they didn’t forward any information to his secondary at all which has caused no end of issues as it does look as though I’ve suddenly decided he has problems when they’ve been there forever but no evidence of anything prior to this year.

It’s not so much that I plan on using it in the appeal - it’s more for evidence to give to his secondary to prove what I’m saying with the issues he’s had. The primary submitted his referrals for ASD, to the mental health team and know all about his school refusal. Nothing on paper to prove any of what I’m saying is true.

Some of the unlawful policies LAs have that some SENDIASS repeat include:
The school needs to spend £6k before you can request an EHCNA/an EHCP will be issued.
The school needs to do 2+ APDR cycles.
The child needs to be 2+ years behind.
The child needs to be in school. You can’t get EHCPs if EHE.
Can’t get EHCP for child in independent school.
EHCPs aren’t for those with good attendance.
Need an EP assessment first.
Can’t get an EHCP with only dyslexia.

These are just some of the examples I have heard parents have been told in the last couple of months. I could carry on.

Raise it further regarding SAR from primary.
Doesnt matter if it's too much hard work for them, shitty and unlawful excuse.
