SEN assessment plan not being met

Hi. I'm posting on behalf of a friend who has asked for my help.
Her 7 year old son is disabled. Swelling on brain, still in nappies, no speech.
He has had an assessment for his needs but basically these are not being met. He was supposed to be moving to a special school this September but was told on the 5th September that they no longer had a place. He is currently being kept in a classroom on his own with 1:1 TA. Both the TA and he have had physical injuries.
My plan is to write to Governors, and start a First-tier Tribunal (Special Educational Needs and Disability).
Anything else we should do?

Some questions to establish more facts first.

  1. Friend’s DS has an EHCP, yes?
  2. When you say ‘He has had an assessment of needs’, do you mean an EHCNA?
  3. When you say ‘but basically these are not being met’, do you mean the provision detailed, specified and quantified in F of the EHCP isn’t being provided? Or do you mean the EHCP isn’t accurate so needs aren’t being met because the content of the EHCP is poor?
  4. What setting is named in section I of the EHCP?
  5. If the special school is named in section I, is it a wholly independent school?
  6. When you say ‘start a First-tier Tribunal (Special Educational Needs and Disability)’, what exactly do you mean? Do you mean an appeal (if so, do they have the right of appeal currently?) or a disability discrimination claim?
