EHCP no school named

Can anyone tell me why the LA wouldnt name a school on a final ehcp? Setting is named but no school, why would this be?

Do you mean type of placement is named but not a specific placement? There are various reasons e.g. the LA dragging their heels with consulting, a ploy to save money, EOTAS/EOTIS actually being required but the LA not wanting to leave section I blank because they don’t like/fail to understand EOTAS/EOTIS…

Have you appealed?

In the meantime, ask the LA how they intend to provide the provision in F (and if compulsory school age DC, a suitable full-time education). If the type of placement named is mainstream, remind the LA case law states where LAs name mainstream as type, they should normally also name a specific placement.

Yes it’s a mainstream that’s why I’m not sure why a place hasn’t been named as surely it would be quite straight forward?

Not necessarily. LAs make a lot thing anything but straightforward. There are various reasons. Sometimes it is a delaying tactic. Although mainstreams that are not wholly independent can be named against their will, sometimes LAs have ‘negotiations’. Sometimes the LA’s incompetence means they finalise to meet the 20 weeks deadline but aren’t ready to name a specific placement even though they should.
