DLA renewal

Hi. Hoping someone can advise me. It’s the dreaded time for my son’s dla to be reapplied for. They’ve asked to send evidence and I was going to send his EHCP, but school and the LA don’t seem to have an updated version. We had review last summer, but no new EHCP seems to have come from it. I’m assuming this will be a problem if I send the latest version we have from 2023?. Does anyone have any idea?

EHCPs aren’t always updated following annual reviews. You should have been informed if the decision was to maintain as is or if the LA proposed to amend. If it was updated following the AR, you should have been sent the finalised version. If it was maintained as is, the existing version continues to be valid.

Send the most recent version.

Thank you for your reply. I didn’t know that and I haven’t heard either way. I just spoke to the school and they don’t seem to know anything either. They sent off all the notes from the review and heard nothing back. No one has chased. So I guess I’ll send this one off and hope for the best. My son’s next review is in June anyway! But dla finishes last day of July.

Separate to DLA, you should chase the LA. IPSEA has a model letter you can use. You should have been informed whether the LA planned to maintain as is, propose to amend or propose to cease to maintain within 4 weeks of the review meeting.

I’ve not heard of IPSEA. I’ll look them up and chase. Yes, regardless of DLA, my son’s info needs to be updated and correct. Sadly, this isn’t a surprise knowing the LA. I was actually surprised when then replied to school within 3 days!
