What happened to equal opportunities?!?

Hi guys just looking for some advice really. So my son currently attends nursery he’ll be 4 at the end of the month. Sports day is tomorrow and they’ve said he wouldn’t be able to attend or take part without a parent/ guardians support as there aren’t enough staff to offer his usual 1:1. I’m slightly annoyed this as it just doesn’t seem fair to my son. Surely this isn’t okay?

Does DS have an EHCP with 1:1 included in there?

Is it a state school nursery?

He doesn’t have an EHCP, we’re in the process of trying to get one in time for September. It is a state school yes. Before he started last September we agreed he’d be supported by. His 1:1. Now im told his 1:1 support won’t be available as she’ll be helping with the sports day. I usually have work on Wednesday but in MAT leave atm otherwise this would have created a whole childcare issue.

Unfortunately, without an EHCP you can’t force the school to provide 1:1. However, the school cannot lawfully ask you to keep DS at home like they have. It amounts to an unlawful, informal exclusion. Complain to the HT. Follow up with an email.

Where are you in the EHCP process?

EHCP is currently with the local council as with anything nowadays, there’s a delay. I just didn’t think it was fair or right so I called the senco this morning who said I should have never been told that and she spoke with his teacher who then said he could come along and I could go along and watch which I had planned to the anyway. It just goes to show they’ll really fob you off if they can. He doesn’t understand luckily enough because I’m sure he’d of felt really crap about it.

Well done for standing your ground.

If the LA is failing to stick to the statutory timescales, email the Director of Children’s Services reminding them of the timescales and informing them if they do not act ASAP you will be forced to pursue legal action. If that doesn’t work, you need a pre-action letter.
