EHCP assessment timelines

I found out last week that my appeal against refusal to assess was successful.

The original decision not to assess was made in December, six weeks after the EHCNA was submitted.

Am I right in thinking that the LA now has a further 10 weeks to carry out the assessment and evidence gathering? Then after the 10 weeks they need to either issue a draft plan or inform me that they do not intend to issue?

It’s obviously about to be the summer break - will this affect timelines?

If the LA is not going to issue they must inform you within 10 weeks of the Order. If they are going to issue they must finalise by week 14.

There is an exception to the timescales if it is impractical for the LA to comply with the timescales because you/DC are out of the area for 2+ weeks or are affected by exceptional personal circumstances during that period of time, or the LA has requested advice from the school during a time when it is closed for 4+ weeks or in the week prior to such a closure. In these cases they must still comply as soon as practicable.
