Send admissions

Hi, my daughter is going to a SEMH secondary school but I’ve just seen the new ofsted which send admissions have sent to me. The school is rate as inadequate. The send admissions are not suspending admissions yet.
We really don’t want our daughter going there after reading the report, when we viewed the school it was needs improvements but we were assured this was being managed etc and with limited schools about the area we went with this school. We’ve now found out we can apply for school out of county so would rather apply elsewhere or at least have that choice seeing how bad the reports are and now from what I’ve read elsewhere.
Does anyone know if I am allowed to decline this school as its send admissions and what would likely happen for a new placement for September.

Speak to the LA. The LA may agree to consult with your now preferred school and amend especially if the school is cheaper than the school currently named.

If the LA force you to request an early review, the EHCP being finalised naming another school by September is unlikely. And that’s if the LA agree to hold an early review, they don’t have to.

Are you still within the appeal window? If this is an existing EHCP, you shouldn’t be, but because LAs sometimes fail to finalise by the statutory deadline, it is worth asking anyway.

I have contacted the LA tonight as I only received the letter email today. I don’t even have another school in mind as we didn’t have a lot of choice the only SEMH school which took girls in our county is this one, so we will be looking at out of county or a school we haven’t yet viewed..
Sounds like we might be stuck with a school which is inadequate. I hope we can either get a move or an early review! It’s just an awful situation just when I think everything is sorted.
I don’t think we are in the time frame for appeal they named the secondary school in February.
